TERMS OF ‘YOUSPOTPROPERTY.COM’ REWARD SCHEME
Interpretation and terms
These terms (the “Terms”) set out the terms on which you may participate in the “report an empty property, get my £20” reward scheme (“Reward Scheme”) provided by us on YouSpotProperty.com (the “Website”).
Our Privacy Policy and Terms of Website form part of these Terms. Please read these terms and policies carefully before participating on the Reward Scheme.
By completing and submitting a ‘Report a property’ form on our Website, you confirm your acceptance of these Terms. If you do not agree to the Terms, do not participate in the Reward Scheme.
References in these Terms to “you” and “your” are to you, the person participating in the Reward Scheme and references to “we”, “us” and “our” are to YouSpotProperty.Com Ltd (trading as You Spot Property).
How to participate
If you are aware of an empty or derelict Property (“Property”), you may participate in the Reward Scheme by following the submission process on our Website, found under the “Report a Property” section (“Applications”). You must follow all the prompts and fill out all information requested to successfully enter the Reward Scheme, including (but not limited to) your contact details and the details of the Property.
The Property must be a residential property, and you will need to know its address to complete the submission process.
There is no limit to the number of Properties you can report under the Reward Scheme, however you cannot report the same Property more than once.
We will not accept responsibility for any application to the Reward Scheme that is corrupted or not successfully completed or transmitted, regardless of cause, including, for example, because of technical malfunction, systems, satellite, network, server, website, computer hardware or software failure of any kind.
By participating in the Reward Scheme, you agree that we may share details of the Property with our business partners or other third parties.
Eligibility
The Reward Scheme is only available to residents in the UK aged 18 years or over.
By participating in the Reward Scheme, you confirm that you are eligible to do so and are eligible to receive any reward offered under the Reward Scheme. Upon request, we may require you to provide proof that you meet the criteria set out below and are eligible to participate in the Reward Scheme.
We will not accept Applications that are:
(a) automatically generated by computer or created by artificial intelligence;
(b) illegible, have been altered, reconstructed, formed or tampered with; or
(c) incomplete.
The Reward Scheme is subject to change and can be withdrawn or amended by us without notice at any time. We will not be liable if for any reason the Reward Scheme (or the Website) is unavailable at any time or for any period and we shall be under no obligation to give prior notice to you (whether on the Website or otherwise) that the Reward Scheme has been (or is intended to be) withdrawn or amended. Any Application to the Reward Scheme following its withdrawal shall be ineligible.
If there is any reason to believe that there has been a breach of the Terms, we reserve the right to find your application to participate in the Reward Scheme ineligible.
Property criteria
A Property will only be eligible under the Reward Scheme if, on the date you report the Property to us in accordance with the participation clause, it meets certain conditions, including (but not limited to) the following:
(a) the Property is not on the open market for sale or rental and has not previously been advertised for sale or to let during the twenty-four-month period immediately prior to your Application;
(b) the Property has been empty for more than twelve months (unless it has recently fallen into probate);
(c) the Property is located in a high-density residential area (i.e., it is not located in a rural area);
(d) the value of the Property is in excess of £100,000;
(e) the Property is residential and is not used for commercial purposes (for the avoidance of doubt, derelict shops and residential properties situated above commercial units are not eligible);
(f) the Property is not listed Grade I or Grade II;
(g) the Property does not have a thatched roof;
(h) the Property has not been purchased within the last five years;
(i) the Property does not form part of our existing database;
(j) planning permission has not been applied for in respect of the Property within the last three years;
(k) the Property does not form part of a high-rise council or ex-council block;
(l) the Property is privately owned (excluding privately owned retirement homes or assisted living properties);
(m) the Property is not currently under refurbishment or development and has not recently been refurbished or developed;
(n) the Property is in England or falls under one of the following Welsh postcodes: CF1, CF3, CF31, CF32, CF33, CF34, CF35, CF36, CF46, CF5, CF61, CF62, CF63, CF64, CF71, CF81, CF82, CF83, CH4, CH5, CH6, CH7, CH8, NP1, NP11, NP10, NP19, NP20, NP2, NP3, SA1, SA2, SA3, SA4, SA5, SA6, SA7, SA18, LL11, LL12, LL13, LL14, LL18, LL19, LL20, SY13 or SY14 (for the avoidance of doubt, properties located in Scotland, Ireland and Northern Ireland are not eligible); and
(o) the Property is, in our opinion, in poor condition as a result of disuse and neglect.
Even where a Property complies with the above, we reserve the right, in our absolute discretion, to deem the Property not eligible under the Reward Scheme for any other reason not listed.
If Google maps is outdated, we reserve the right to request picture confirmation of the Property before proceeding with the application to the Reward Scheme. The Property will only be considered once sufficient picture confirmation has been provided.
Gift Voucher Rewards
If the Property is deemed eligible and you have properly complied with the participation and eligibility provisions, your name will be added to a list of qualifying participants (“Qualifying Participants”) who may receive a £20 gift voucher issued by Marks and Spencer, Amazon.co.uk or VEX (Voucher Express) (or some other third party retailer of our choice from time to time) (“Voucher”).
We reserve the right to decide which Qualifying Participants shall receive a Voucher and, for the avoidance of doubt, not all Qualifying Participants shall automatically be entitled to receive a Voucher.
If you are a Qualifying Participant who has been selected to receive a Voucher, we will notify you by email within 30 days from the end of the calendar month in which your Application was submitted, except in exceptional circumstances where this may be delayed up to a further 60 days.
The Voucher will be emailed or posted to the address supplied by you. The Voucher cannot be refunded or exchanged for its cash value and will remain subject to the terms and conditions of the issuer.
We are not the issuer of the Voucher or the provider of the services redeemable by the Voucher. When a Voucher is redeemed, you are entering into a separate contract with the issuer and it is the issuer who is solely responsible for the redemption of the Voucher and for providing you with the corresponding products and/or services. We will not be liable to you for any losses incurred by you in relation to your use of the Voucher.
You must not reproduce, sell, re-sell or trade any Voucher which we provide to you, or engage in any unlawful activity in connection with the use of a Voucher. Any attempt to do so may, at our discretion, lead to you becoming ineligible from receiving further rewards under the Reward Scheme.
We are not responsible for any lost, stolen or damaged Voucher, or for your failure to redeem the voucher in advance of the expiry date.
Cash Reward
By entering the Reward Scheme, you may be eligible for a cash reward. The cash reward will be equal to one per cent (1%) of the actual purchase price of the Property following completion of its purchase by us (the “Cash Reward”), subject to a cap of £10,000.
You will be eligible for the Cash Reward if:
(a) you notify us of a Property and, as a result, we purchase the Property;
(b) you have no financial interest in the sale and/or purchase of the Property;
(c) the Property complies with the stated criteria; and
(d) you are not in breach of any of the Terms.
We may also, in our absolute discretion, decide to make a donation to a local charity of our choice of not less than £500.
We reserve the right not to purchase a Property for any or no reason. Where we decide not to purchase a Property, we are under no obligation to inform you of our reasons or to keep you updated.
Ineligibility and exclusivity
Regardless of whether the criteria above have been complied with, you will not be deemed eligible for the Cash Reward if:
(a) a competing offer for the Property has been made by you or someone associated with you;
(b) you reported the Property to a competitor prior to or following your entry to the Reward Scheme (unless to a local authority); or
(c) we decide you are ineligible for any other reason.
Claiming the Cash Reward
If you are deemed eligible, we will notify you of the Property’s purchase and confirm the Cash Reward by email within 30 days of completion.
You must claim the Cash Reward by completing and returning the bank detail request form within 30 days of notification. Payment will be made within 30 days thereafter.
Failure to claim within the 30-day period may result in an invalid claim.
We are not responsible if you cannot claim the Cash Reward or if incorrect information prevents notification or payment.
Limitation of liability
We are not liable for any loss or damage incurred from your participation or receipt of the Voucher or Cash Reward. Your statutory rights are unaffected. Our obligation is limited to providing a Voucher or Cash Reward where eligible.
Confidentiality
You agree not to disclose the Property’s purchase price, the Cash Reward amount, or any other confidential business information without our permission.
Your personal information
You agree to us sharing your personal information with partners where necessary. See our Privacy Policy on the Website for more information.
Force Majeure
We are not liable for delays or failures caused by events beyond our control.
Entire agreement
You acknowledge that you have not relied on any representation not set out in these Terms.
Jurisdiction and applicable law
These Terms are governed by English law.
You agree that the courts of England and Wales have exclusive jurisdiction.
